RCMP officer sued over alleged accident on Lake Babine Reserve

An RCMP officer is being taken to court for a vehicle – cyclist collision involving a 10 year old boy near Burns Lake.

The claim filed in Prince George Supreme Court this week states the accident took place on July 8th 2015 on the Lake Babine Reserve. It names RCMP officer Aaron Semmler, who was on duty at the time, alleging the boy was riding eastwards on Tsa Street while Semmler drove south on Sus Avenue eventually colliding.

The lawsuit claims the boy suffered head injuries, contusions, abrasions swelling and pain that will continue to contribute to a loss of enjoyment of life.

The notice alleges the accident was “caused solely by the negligence of the RCMP member”, specifically claiming Semmler was driving too fast and without due care. None of the allegations have been proven in court.

General and special damages are being sought, in addition to healthcare and legal costs. Minister of Justice Suzanne Anton is also named in the lawsuit.
